A) GENERAL TERMS (Applicable to All Users)

1. Acceptance of Terms

By accessing or using our website, mobile site, mobile application (if any), WhatsApp or messaging platforms, call center, physical office, social channels, or B2B portal (collectively, the “Sales Channels”), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use our Services.

2. Role of FlynextTrip

FlynextTrip acts solely as an intermediary or agent between you and third-party travel service providers, including but not limited to airlines, GDS/OTAs, hotels, destination management companies, transport operators, visa centers, insurance providers, and digital content platforms.

Your booking, purchase, or use of any service is also governed by the relevant supplier’s own terms, conditions, fare rules, and policies, which you agree to accept.

3. Eligibility & Account Responsibility

You must be at least 18 years old and legally capable of entering into a binding contract. You are responsible for:

  • Providing accurate, complete, and current information.
  • Maintaining the confidentiality of your account credentials.
  • All activities carried out under your account or contact details.

4. Booking & Contract Formation

By clicking “Book”, “Pay”, or “Confirm”, you submit an offer to purchase a service. A binding contract is formed only when:

  • Full payment is received, and
  • The supplier confirms the booking (e.g., e-ticket, PNR, hotel voucher).

Name corrections or changes after issuance are generally not permitted and are subject strictly to supplier rules.

5. Pricing, Taxes & Currency

Prices are dynamic and may change due to availability, fare rules, or currency fluctuations. Unless stated otherwise:

  • Prices include applicable taxes and fees.
  • Local taxes, city taxes, or resort fees may be payable directly to hotels.
  • Once a service is issued, price differences are non-refundable.

You agree to pay all applicable government taxes, supplier charges, and surcharges.

6. Payments, Fraud & Chargebacks

Payments are processed through third-party gateways, wallets, or banks. We reserve the right to cancel or hold suspicious transactions and request KYC documents.

In case of chargebacks or payment disputes, you authorize FlynextTrip to recover losses, penalties, or bank fees by adjusting refunds, B2B wallet balances, or issuing invoices.

7. Cancellations, Changes, Refunds & No-Shows

All cancellations, changes, and refunds are governed strictly by supplier rules. Service fees and penalties may apply.

  • Refunds (if permitted) are processed only after funds are received from the supplier. Processing timelines vary.
  • Failure to use a service without prior cancellation (“No-Show”) usually results in no refund.

8. Schedule Changes & Flight Disruptions

Airlines may change schedules, aircraft, routing, or cancel flights. We will notify you when informed. Reaccommodation or refunds are subject to airline policy. FlynextTrip is not liable for missed connections or additional costs beyond airline rules.

9. Travel Documents, Visas & Immigration

You are solely responsible for passport validity, visas, health/vaccination requirements, and immigration compliance. Visa services, if provided, are assistance only. Visa approval is never guaranteed, and fees are non-refundable.

10. Baggage & Special Requests

Baggage allowances vary by airline, fare, and route. Seat selection, meals, frequent flyer benefits, and special assistance are requests only, unless confirmed by the supplier.

11. Hotels, Holidays, Tours & Transfers

Images and descriptions are supplier-provided. Room types (e.g., bedding, smoking preference) are requests unless confirmed in writing. Seasonal surcharges and blackout dates may apply.

12. Force Majeure

FlynextTrip is not liable for events beyond reasonable control, including but not limited to natural disasters, pandemics, strikes, weather disruptions, technical failures, or government actions.

13. Prohibited Activities

You must not make fraudulent bookings, misuse systems, or scrape inventory. We may suspend accounts or pursue legal remedies for violations.

14. Intellectual Property

All content is owned or licensed by FlynextTrip. No content may be copied, reproduced, or distributed without written permission.

15. User-Generated Content (UGC)

By submitting reviews or content, you grant FlynextTrip a worldwide license to use such content. Do not post sensitive information publicly.

16. Liability & Indemnity

FlynextTrip is not liable for supplier failures, visa refusals, schedule changes, or indirect losses. You agree to indemnify FlynextTrip against claims arising from your breach of these Terms.

17. Privacy & Data Protection

Our Privacy Policy governs how we collect and process personal data. By using our Services, you consent to such processing.

18. Amendments

We may modify these Terms at any time. Continued use after updates constitutes acceptance.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of Bangladesh. Courts of Dhaka, Bangladesh have exclusive jurisdiction.

B) B2C (RETAIL CUSTOMERS) – ADDITIONAL TERMS

1. Multi-City & Complex Air Tickets

Multi-city itineraries are subject to strict fare rules. The most restrictive rule across all segments applies.

2. Refund Timing

Refunds are processed only after supplier settlement. Gateway, bank, and service fees may be non-refundable.

3. Promotions & Credits

Promotions are time-bound, non-transferable, and subject to withdrawal without notice.

4. Travel Insurance

Travel insurance is strongly recommended and not included unless stated.

5. Customer Responsibilities

You must ensure traveler names match passports, review documents within 24 hours, and comply with airline/immigration requirements.

C) B2B (AGENTS & PORTAL) – ADDITIONAL TERMS

1. Registration & KYC

By using the FlynextTrip B2B Portal, you accept these Terms and must maintain valid business and KYC records.

2. Net Rates & Markups

B2B rates are net. Markups and onward sales are your responsibility.

3. Agent Wallet / Float

Excess funds are non-withdrawable and usable only for services. Negative balances or debit memos may be adjusted or invoiced.

4. Client Responsibility

You are solely responsible for your customers and onward contracts. FlynextTrip bears no liability for your customer disputes.

5. Misuse & Termination

We may suspend or terminate B2B accounts for misuse, fraud, or supplier rule violations.

D) SERVICE-SPECIFIC TERMS
  • Flights: All segments follow the strictest applicable fare rule. Separate tickets may require re-check of baggage.
  • Hotels, Tours & Transfers: No amendments after confirmation unless allowed by suppliers.
  • Visa Services: Assistance only; embassy decisions are final. Fees are non-refundable.
  • Umrah: Subject to Saudi regulations, airline availability, and local operator capacity.
E) COMMUNICATIONS & F) AGREEMENT

You consent to receive transactional communications via email, SMS, WhatsApp, or calls. Marketing messages can be opted out.

If any clause is unenforceable, the remainder remains valid. These Terms, supplier rules, and our Privacy Policy form the entire agreement.
